These Terms of Service ("Terms") govern your use of excinternational.org (the "Site") and any donation, purchase, form submission, or other interaction with EXC International Corporation ("EXC," "we," "us," or "our"). By using the Site or making a donation, you agree to these Terms. If you don't agree, please don't use the Site.

Who We Are

EXC International Corporation is a nonprofit corporation recognized as tax-exempt under Section 501(c)(3) of the U.S. Internal Revenue Code (EIN 92-3953750). Our work includes water delivery through Water Xchange, home construction and repair, youth surfboard and skateboard donations, Montessori school support, and related community projects.

Eligibility

You must be at least 18 years old, or the age of legal majority where you live, to make a donation or purchase. By donating, you confirm that you are authorized to use the payment method you provide.

Donations

Voluntary gifts. All donations are voluntary, unconditional gifts to EXC. No goods or services are provided in exchange for a donation unless we state otherwise in writing.

Use of funds. Donations support all EXC missions and projects. If you indicate a preference for a specific program, we will make reasonable efforts to honor it, but EXC retains full discretion and control over how all donated funds are used, consistent with our charitable purpose.

Tax receipts. We email a receipt for each donation. Whether and how much of your donation is deductible depends on your personal tax situation and the laws where you file. We do not provide tax advice. Please consult a tax professional.

Recurring (Monthly) Donations

This section applies if you choose a recurring donation option at checkout.

Your authorization. When you select a recurring donation and complete checkout, you authorize EXC and our payment processor to charge the payment method you provide, in the amount and at the frequency you selected (for example, monthly), starting on the date of your first donation and continuing on the same day each period until you cancel. Your recurring donation does not end on its own.

Confirmation. After you sign up, we send a confirmation email showing your donation amount, and frequency. Please keep it for your records. You will also receive a receipt each time a payment is processed.

Your responsibility to cancel. You are responsible for managing and canceling your recurring donation. You can cancel at any time, on your own, through your donor account:

1. Log in at via our portal login in the header of our homepage.

2. Go to Donations / Subscriptions

3. Select your recurring donation and choose Cancel if you wish to cancel.

Cancellation takes effect immediately for all future payments. To avoid the next scheduled charge, please cancel at least two (2) business days before your next payment date.

If you can't access your donor account, you can also email us at Hello@EXCInternational.org with your name, the email used to donate, and the request to cancel. Email requests are processed within [7] business days.

Changes to your donation. You can update your payment method or cancel through your donor account at any time. To change your amount, cancel your current recurring donation and start a new one.

Failed payments. If a scheduled payment fails, we or our payment processor may retry the charge and notify you by email. If payment continues to fail, your recurring donation may be paused or canceled.

Keep your email current. We send confirmations, receipts, and notices to the email you provided. You are responsible for keeping it up to date and for reviewing those messages.

Refund Policy

Donations are generally non-refundable. Because donations are put to work quickly in the field, all donations, including each payment of a recurring donation, are final once processed.

This includes recurring payments processed before you canceled. Forgetting to cancel, not reviewing receipts, or no longer wishing to donate are not grounds for a refund of payments already made.

Exceptions. We will refund a donation if, within thirty (15) days of the charge, you contact us and show that:

• you were charged more than once for the same donation (duplicate charge),

• you were charged an amount different from what you authorized (processing error), or

• the charge was made without your authorization (fraud), or

• a payment was processed after you completed cancellation through your donor account.

Any other refund is at EXC's sole discretion. If a refund is issued, the related tax receipt is void and the amount is no longer a charitable contribution.

Contact us first. If you have a question or concern about a charge, please contact us before disputing it with your bank or card issuer. Most issues can be resolved quickly and directly. Filing a dispute for a charge you authorized may result in cancellation of your recurring donation and our sharing of your authorization records with your card issuer.

Merchandise

Purchases of all merchandise are sales, not donations, and are not tax-deductible. Proceeds support EXC's missions. Merchandise is produced and shipped by third-party fulfillment partners. Returns, exchanges, and shipping are governed by the policy shown on the product or checkout page.

Programs and Assistance Requests

Submitting a request for assistance (including through the Water Xchange intake form) does not guarantee that EXC will provide services. Services are provided at our discretion and depend on available funds, volunteers, logistics, weather, and safety conditions. Delivery dates and quantities are estimates, not commitments. Recipients are responsible for the safe storage and use of any water or materials delivered.

Volunteers

Volunteering with EXC is voluntary and unpaid. Volunteers may be asked to sign a separate volunteer agreement and waiver, which will govern that activity.

Use of the Site

You agree not to use the Site to break any law, submit false or misleading information, impersonate anyone, interfere with the Site's operation, attempt unauthorized access to any account or system, or use stolen or unauthorized payment methods.

Intellectual Property

All content on the Site, including text, photos, videos, logos, the EXC name, and the No Más Excusas brand, belongs to EXC or its licensors and is protected by law. You may share links to our content and share our posts for non-commercial purposes with credit to EXC. Any other use requires our written permission.

If you submit content to us (photos, stories, testimonials, comments), you grant EXC a non-exclusive, royalty-free, worldwide license to use it in connection with our mission and outreach, and you confirm you have the right to grant that license.

Third-Party Services

Donations and purchases are processed through third parties such as Squarespace, Stripe, and PayPal Giving Fund. Your use of those services is also subject to their terms and privacy policies. EXC does not store full payment card numbers and is not responsible for the acts or failures of third-party services.

Our collection and use of personal information is described in our Privacy Policy.

Disclaimers

The Site and all information on it are provided "as is" and "as available," without warranties of any kind, express or implied. Articles and educational content are for general information only and are not legal, medical, financial, or engineering advice. We do not guarantee the Site will be uninterrupted or error-free.

Limitation of Liability

To the fullest extent permitted by law, EXC and its directors, officers, volunteers, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, our programs, or these Terms. Our total liability for any claim relating to a donation or purchase will not exceed the amount you paid for that specific transaction.Indemnification

You agree to indemnify and hold EXC harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.

Governing Law

These Terms are governed by the laws of the Commonwealth of Puerto Rico and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute will be resolved in the courts.

Changes to These Terms

We may update these Terms from time to time. The updated version will be posted here with a new effective date. Changes do not apply retroactively to donations already processed. If we make a material change affecting active recurring donations, we will notify affected donors by email.
